Bell MTS Arbitration – Queen’s Funeral

IBEW 435 Members at Bell MTS,

Arbitrator Graham has issued his award on the Queen’s Funeral/Scheduled day of rest grievance. 

 

Unfortunately IBEW 435 was not successful. Though, Arbitrator Graham found that both parties’ interpretive arguments had merit, ultimately he concluded that “scheduled day of rest” only applies to changes to an employee’s regular schedule, and not to the specific circumstances in relation to September 19, 2022.

He did find that it would be inequitable for the Employer to clawback any overtime that had been paid out in respect to the schedule change at this stage.
